Q. I learned of a plan by our board to insure three part-time employees with medical and dental coverage. Two of the employees have children and the board plans to cover all of them. It is my understanding that part-time employees are rarely covered by workers' insurance. We have only 154 units. The board claims they are complying with new rules. A. If the hours worked are fewer than 32 hours a week, it would be most unusual for your board to provide insurance coverage. Providing insurance for fewer than 32 hours a week is not mandatory by any law. As for covering the children, you need to find out if the association plans to pay for the children or whether the employees will pay through payroll deductions. Q. There are several recent decisions by the board with advice from the attorney that appear contrary to the intent of the recorded covenants regarding commercial vehicles. The covenants state that no commercial vehicle or recreation vehicle may be parked at any unit or within the project unless the entire vehicle is located within a garage or otherwise adequately screened from view. The board determined that covering the vehicle would satisfy that particular rule. I am in the process of filing a complaint with the Real Estate Division. Is there anything else that I can do without having to spend much money, as with a messy lawsuit? A. No. The least expensive is the dispute resolution process through the Real Estate Division, which is quite possibly the fastest format to resolve problems as well.
